Yes. Why?

-He has presided over the suspension of habeas corpeas, a rule that has been in effect in the USA since the British colonial era, predating even the U.S. Constitution.

-He has given not only tacit approval, but has bluntly stated that the Geneva Conventions on the treatment of foreign combatants will not be applied to people captured in Afghanistan and Iraq (and other places?). Whether these people genuinely fit the full-definition of enemy combatant (belong to the armed forces of a hostile government, etc.) is immaterial in my view. People should be treated with respect and torture is never a valid option. You don't change people's minds to your viewpoint by humiliating them and subjecting them to emotional/physical/mental trauma. That creates life-long enemies, both among the mistreated and their home cultures. Japan and Germany have become what they are today in part because of the treatment they received after their defeat in World War II.

Wow. That's just for starters.
